As has been repeatedly reported, the deputy district administrator is accused of aiding and abetting gang and commercial smuggling in connection with the import and sale of solar modules. The public prosecutor’s office assumes damages in excess of 30 million euros. Since march, pech has been one of five defendants before the district court of nurnberg-furth. However, the proceedings were suspended at the beginning of july after numerous days of hearings, including the reading of the indictment and the questioning of witnesses, whereupon pech filed a renewed application for suspension from office. This has now been rejected and the suspension thus confirmed once again by the courts.
Important customs documents missing
As justice press spokesman friedrich weitner announced on tuesday when asked, nothing is progressing in the criminal case at the moment. "Important customs documents from holland are still missing, without which the proceedings cannot be rescheduled." As soon as the court has these documents, the process can begin again.
Which means that everything starts all over again. "A process can only be interrupted for a certain period of time", explains weitner. The "principle of immediacy prescribes a stringent hearing without rough breaks, so that the court can get a complete overall picture of the case. "That’s why it’s starting from scratch again", according to weitner.
With the suspension of the proceedings, however, the arrest warrant against pech was also lifted.
However, the administrative court of ansbach did not see this as a reason for the existing suspicion of the crime to cease to exist. The prognosis that the disciplinary proceedings will be "overwhelmingly probable the removal of the witness from his position as a civil servant is still in effect, according to the state prosecutor’s office.
